Terms of Service

By creating an account, embedding our widget, or paying for any plan or audit package, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service. If you use the service on behalf of an organisation, you represent that you have authority to bind that organisation.

ADAWCAG.org provides automated and human-assisted accessibility-compliance scans, audits, and reports against the WCAG 2.1 / 2.2 standards, ADA Title II and Title III, Section 508, EN 301 549, and related criteria. The service is offered as monthly subscriptions (Starter, Pro, Agency, Custom Enterprise), municipal tiers (City Pilot, City Standard, City Enterprise), and one-time audit packages purchased from the Audit Bounty Board.

We may change product features, pricing, or quotas at any time. Material changes will be announced at least 14 days in advance for active customers.

• You are responsible for keeping your credentials confidential and for all activity under your account.
• You must provide accurate registration information and keep it current.
• You may not share, resell, or transfer your account without our written consent.
• We may suspend accounts engaged in abuse, spam, fraud, or activity that threatens the platform.

You agree not to:

• Scan websites you do not own or have explicit written permission to scan.
• Use the service to send unsolicited commercial email or otherwise violate the CAN-SPAM Act, TCPA, or comparable laws.
• Attempt to gain unauthorised access to other tenants' data, reverse-engineer the service, or interfere with rate-limiting.
• Upload content that is unlawful, infringing, defamatory, or contains malware.
• Use the service to provide a competing accessibility-scanning product.

• Subscriptions are billed in advance, monthly, in U.S. dollars. They auto-renew until you cancel from Account Settings or by emailing justin@adawcag.org.
• Free passes / trials may be granted at our sole discretion. Free-pass tenants are entitled to the full feature set during the pass window; the pass converts to a paid subscription only with your explicit consent.
• Audit Bounty Board purchases are one-time charges. If we cannot deliver an audit within the timeline shown on the package, we will issue a full refund. Otherwise audit purchases are non-refundable once delivery has begun.
• Refunds for subscriptions are pro-rated for the unused portion of the current billing month if you cancel within 30 days of first sign-up. Outside that window, you keep access until period-end and are not billed further.
• Disputes & chargebacks trigger immediate account suspension pending resolution.

You own your customer data — the URLs you submit, scan-result PDFs, and any content you upload. We retain only the licence necessary to operate the service: to host, scan, render, transmit, back up, and (where you opted in) email reports on your behalf.

We own the platform, the scanner engine, the AI prompts, the report templates, all aggregated and de-identified analytics, and any feedback you give us. The PDF, VPAT, ACR, and HTML deliverables we generate are licensed to you for internal and external use; you may share them with auditors, customers, and government procurement officers without restriction.

We target 99.5% monthly uptime for the dashboard and embeddable widget, and a 72-hour first-scan turnaround for paid subscribers. There is no SLA on free passes. Scheduled maintenance windows are announced at least 48 hours in advance. We are not responsible for outages caused by your DNS provider, hosting platform, or upstream third-party services (Stripe, IPinfo, Zeptomail, etc.).

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. We make no warranty that automated scans will identify every accessibility barrier on your site. An ADAWCAG.org scan is not a substitute for a human accessibility audit by a Trusted Tester, and is not legal advice. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service will not exceed the greater of (a) the fees you paid to us in the twelve months preceding the claim, or (b) US$100. We will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, or lost data, even if we have been advised of the possibility of such damages.

You will indemnify and hold harmless UAIU Holdings Corp and its officers, directors, and employees from any third-party claim arising out of (a) your breach of these terms, (b) your customer data, or (c) your use of the service in violation of law.

You may close your account anytime from Account Settings or by emailing justin@adawcag.org. We may terminate or suspend access for material breach with reasonable notice where practicable. On termination, we will delete your scan data within 30 days unless retention is required by law (audit logs are retained for 7 years).

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts located in California. Each party waives the right to a jury trial. Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidentiality.

We may amend these terms by posting a revised version on this page and updating the Effective date. If we make material changes, we will notify active customers by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
